Middletown Man Charged After Investigation

Orange County District Attorney David M. Hoovler and City of Port Jervis Police Chief William Worden announced that Dylan M. Benner, 21, of Middletown, was arrested and charged with Predatory Sexual Assault Against a Child.  Benner was subsequently arraigned in the Centralized Arraignment Part and remanded to the Orange County Jail without bail.

Police allege that on or about August 1, 2023 Benner solicited a ten (10) year old female child online and did then meet the child within the confines of the City of Port Jervis, NY, where he engaged in an act of sexual intercourse with the victim. Benner was arrested on August 3rd, 2023, and charged with one (1) count of New York State Penal Law section 130.96, Predatory Sexual Assault Against a Child, a class A-II felony.

City of Port Jervis Police investigated the incident, with the assistance of the New York State Police Troop F Forensic Identification Unit, the Orange County Child Advocacy Center, the Orange County Child Abuse Unit, and the Orange County District Attorney’s Office.

The case is being prosecuted by Senior Assistant District Attorney Ryan Greenbaum.

A criminal charge is merely an allegation by the police that a defendant has committed a violation of the criminal law, and it is not evidence of guilt. All defendants are presumed innocent and entitled to a fair trial, during which it will be the State of New York’s burden to prove guilt beyond a reasonable doubt.
