District Attorney Hoovler Announces Guilty Plea in Child Rape Case

Justin Babb Faces up to 18 Years in Prison

Orange County District Attorney David M. Hoovler announced that on Thursday, May 23, 2024, Justin Babb, age 41, of New Hampton, pled guilty in Orange County Court to Criminal Sexual Act in the First Degree.  At sentencing on August 29, 2024, the People will recommend that he be sentenced to eighteen (18) years in prison to be followed by ten (10) years of post-release supervision.  As part of the sentence, Babb will also be registered as a sex offender under the New York Sex Offender Registration Act (SORA).  At the plea proceedings, Babb admitted that in August, 2023 he did engage in anal sexual conduct with an individual who was less than eleven (11) years old.

District Attorney Hoovler thanked the Orange County Child Abuse Investigation Unit for their investigation which led to the arrest of the defendant.

“This defendant’s unspeakable actions demand a lengthy prison sentence,” said District Attorney David M. Hoovler. “It isinconceivable that a child could be subjected to the horrific acts perpetrated by this offender.  To be clear, my Office, together with our law enforcement partners, will never stop seeking to hold sexual predators accountable for their conduct.  We will continue to ensure justice is served in these challenging cases.”

The case is being prosecuted by Senior Assistant District Attorney Julie Mohl.

A criminal charge is merely an allegation by the police that a defendant has committed a violation of the criminal law, and it is not evidence of guilt. All defendants are presumed innocent and entitled to a fair trial, during which it will be the State of New York’s burden to prove guilt beyond a reasonable doubt.
