District Attorney Hoovler Announces Guilty Plea in Attempted Rape of a Child
James Pospisil Faces up to 15 Years in Prison
Orange County District Attorney David M. Hoovler announced that on Monday, June 24, 2024, James Pospisil, age 45, of Port Jervis, pled guilty in Orange County Court to Attempted Rape in the First Degree. At sentencing on September 17, 2024, the People will recommend that he be sentenced to fifteen (15) years in prison to be followed by fifteen (15) years of post-release supervision. As part of the sentence, Pospisil will also be registered as a sex offender under the New York Sex Offender Registration Act (SORA). At the plea proceedings, Pospisiladmitted that between December 22, 2023 and January 2, 2024he did attempt to engage in sexual intercourse with an individual who was less than eleven (11) years old.
District Attorney Hoovler thanked the Orange County Child Abuse Investigation Unit for their investigation which led to the arrest of the defendant.
“This defendant’s admitted conduct is a vile and unspeakable act of abuse of an innocent child,” said District Attorney David M. Hoovler. “I hope that the significant sentence the defendant faces will provide a degree of closure to the victim and will ensure that this defendant is unable to harm others. My Office, together with our law enforcement partners, will bring to bear all resources available to us in our pursuit of sexual predators. We will continue to provide support for victims of sexual assault and seek to hold offenders accountable for their actions.”
The case is being prosecuted by Assistant District Attorney Nicholas Mangold.
A criminal charge is merely an allegation by the police that a defendant has committed a violation of the criminal law, and it is not evidence of guilt. All defendants are presumed innocent and entitled to a fair trial, during which it will be the State of New York’s burden to prove guilt beyond a reasonable doubt.
